RE: Adequacy Issues for Amendment (AM-07), Thomas Pit, Permit No. M-7976-020.
Dear Mr. Potter:
On February 15, 2002, DMG received a complete application for AM-01 to the Thomas Pit.
Pursuant to Rule 1 .4.9, DMG cannot issue its recommendation for approval, approval with
conditions, or denial of AM-01 prior to May 9`h, but must issue its recommendation no later than
May 15`". Please be advised that AM-01 may be deemed inadequate, and may be denied on May
15, 2002, unless the following adequacy review issues are addressed to the satisfaction of DMG.
1 . Affidavit of posting of the public notice required by Rule 1.6.2(1)(b), indicates that the
required notice was posted on site on February 5, 2002. However, the copy of the notice
provided with the affidavit does not certify that the notice displayed the name of the applicant,
the address and phone number of the applicant, or the county name and location of the Clerk and
Recorder's Office where the application could be reviewed. Please provide copy of the public
notice posted in accordance with Rule 1.6.2(1)(b).
2. Pursuant to Rule 3.1.5(3), please provide copy of the manufacturers specification for the
Excelsior S-2 erosion control mat, proposed for stabilization of the river bank. Please clarify that
the erosion control mat will be installed in accordance with manufacturers recommendations for
such use.
3. Thank you for providing copy of your correspondence to CDPHE, dated April 18, 2002,
informing CDPHE of the abandoned sewage treatment ponds and requesting guidance from
CDPHE regarding the removal of the ponds. Please clarify that the applicant will comply with
CDPHE requirements regarding removal of the ponds.
4. Pursuant to Rule 6.4.4(f)(i) and (ii), please clarify the depth of the deposit to be mined and
the nature of the stratum immediately beneath the deposit to be mined.
