B&B Excavating, Montgomery Pi[, Permit No. M-1986- 1/ <br />104, AM-O1 <br />Dear Mr. Means: <br />This letter is being written in response to your letter dated September 15, 2003, concerning the <br />Town of Eagle's comments for the above referenced permit amendment. The intent of our letter <br />dated September 8; 2003, was to voice concern about the proposed amendment. The main issues <br />we identified, dealt with the timing of the proposed amendment, the resulting impacts and the <br />necessity for the use to acquire county zoning and land use permits. We realize that the Division <br />of Minerals and Geology (the "DMG") does not have the statutory authority to require the <br />applicant to obtain all land use approvals from Eagle County prior to the approval of the <br />amendment. Nonetheless, the issues raised by the Town will have to be addressed in order for the <br />proposed post-mining land use to be implemented. <br />It is the Town's understanding that if AM-Ol is approved, the applicant will be clearly directed <br />in the decision of approval that all County land use approvals will have to be sought and issued <br />before implementing the amended reclamation plan. If the Applicant does not, it will require a <br />subsequent amendment to the reclamation plan back to the original (rangeland) post-mining land <br />use or something agreeable to all parties prior to any release of the permit and bond.
