~~ =, <br />MINERAL EXTRACTION <br />LEASE <br />This Lease made this ~ day of 2003 by and between Oren C. <br />Nicholson Jr. of the County of Morgan, State of C orado, hereinafter sometimes referred to <br />"Lessor" and the Boazd of County Commissioners of Washington County, State of Colorado, <br />hereinafter sometimes referred to "Lessee" for the consideration as set forth hereinafter: <br />WITNESSTH: <br />WHEREAS, Lessor is the owner of certain real property as descnibed in Exhibit A, <br />attached hereto; and <br />WHEREAS, the County as Lessee desires to extract materials from said property as <br />hereinafter deSned for use by the Washington County Road and Bridge Department; and <br />WHEREAS, the parties to this lease heretofore have agreed upon certain terms, <br />conditions and provisions to allow the County to extract said gravel; <br />NOW THEREFORE, the parties to this agreement covenant and agree as follows. <br />1. Lessor, in consideration of the terms set forth herein, leases to Lessee a tract of land as <br />more fully described in Exhibit A attached hereto, for the purpose of mining, removing, <br />marketing and utilizing all sand, gravel and rock, collectively referred to as "raterials" located <br />within the conSnes of the property. <br />2. Lessee shall be responsible for obtaining any and all permits required by the Mined <br />Land Reclamation Boazd of Colorado, and be responsible for complying with any and all rules <br />and regulations of said Boazd as may be required for the extraction of minerals from said <br />property, including the requirements for proper closure of said gravel pit. <br />3. This lease shall be effective from the date as hereinabove set forth for successive <br />periods of one year and shall be renewed upon an annual written extension executed by the <br />parties hereto. <br />4. Lessee shall pay to Lessor, as royalty, $ 0.50 (cents) for each cubic yazd of materials <br />removed from the property. Lessee shall forwazd to Lessor monthly reports showing the quantity <br />of materials removed during the proceeding month, according to truckloads, with a detailed daily <br />log or schedule of loads taken from the pit.
