<br />FINDINGS OF THE STATE ENGINEER <br />IN THE MATTER OF AN APPLICATION FOR A PERMIT TO CONSTRUCT A WELL IN WATER <br />DIVISION NO. 4, MONTROSE COUNTY, COLORADO <br />APPLICANT: UNITED COMPANIES OF MESA COUNTY, INC. <br />FILE NO.: AD- I ~~~ <br />In compliance with C.R.S. 37-90-137(1), United Companies of Mesa County, Inc., <br />(hereinafter "applicant") submitted an application for a permit to construct a well. Based on <br />the information provided by the applicant and the records of the Division of Water Resources, <br />the State Engineer finds as follows: <br />1. The application was received complete by the State Engineer on August 1, 1996. <br />2. The proposed well will be located in the SW 1 /4 of the NW 1 /4 of Section 13, Township <br />45 North, Range 13 West, New Mexico Principal Meridian. <br />3. The proposed location is outside the boundaries of a designated ground water basin. <br />4. The applicant proposes to apply the water diverted from the well to the following <br />beneficial uses: Washing sand and gravel aggregates, dust suppression and evaporation <br />losses. <br />5. The proposed maximum pumping rate of the well is 200 gallons per minute. <br />6. The proposed average annual amount of ground water to be appropriated is 11.8 <br />acre-feet. <br />7. At the proposed depth of 200 feet, below land surface, ground water diverted by the <br />well would be hydraulically connected to Maverick Draw, a tributary to the San Miguel <br />River System. Diversion of ground water by the well will influence the rate or direction <br />of movement of water in those natural streams and their alluviums. <br />8. Maverick Draw and the San Miguel River Systems are overappropriated. At some or all <br />times of the year, the water supplies for said stream systems are insufficient to satisfy <br />all of the decreed water rights senior to an appropriation by the applicant. <br />r <br />9. The proposed diversion from the subject well would cause depletion to Maverick Draw <br />and the San Miguel River Systems at times when the streams are overappropriated. <br />10. No plan for augmentation to remedy the injury has been approved by the Division 4 <br />Water Court. <br />
