Lamm <br />Governor <br />October 24, 1985 <br />Mr. David Sturges <br />Delaney and Balcomb, P.C. <br />Drawer 790 <br />Glenwood Springs, Colorado 81602 <br />RE: Meadows No. 1 Mine - Bond Release Applications - File No. C-029-81 <br />Dear Mr. Sturges: <br />In response to your request, the following letter details deficiencies in Sun <br />Coal Company's Bond Release Applications, and outstanding issues currently <br />being examined by the Division. This letter is a summary of previous verbal <br />and written communication with the operator and landowner. <br />I. Bond Release Aoalication Deficiencies - Phase I (60%) Bond Release <br />Phase I bond release of up to sixty percent is warranted under <br />Rule 3.03.1(2)(a) upon successful completion of backfilling, regrading <br />and drainage control, in accordance with the approved reclamation plan. <br />The Bond Release Applications were deficient with respect to Phase I in <br />that they did not demonstrate that the reclamation performed on site was <br />successful as per Rule 3.03.1(2)(a). In order to fulfill this <br />requirement, the operator must submit certified statements by a <br />registered professional engineer licensed to practice in the State of <br />Colorado, testifying that the operator has successfully completed <br />backfilling, regrading and drainage control, in accordance with the <br />approved reclamation plan. Specifically, these statements should <br />include: <br />A. Pit Area <br />- Designed vs. As-Built Topography <br />- Drainage Pattern Establishment <br />- Slope Inclination <br />- Evidence of Instability <br />- Proper Burial of Acid-Forming or Toxic Material <br />B. Haul Road <br />- Grade and Alignment <br />- Road Surfacing <br />- Drainage Features with Respect to Plan and Function <br />- Evidence of Instability of Both Cut and Fill Embankments <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
