Request for Proposed Decision Extension beyond Mazch 1, 2006
Dear Mr. Nettleton:
The Division of Minerals and Geology received BTU Empire Corporation (formerly known as RAG-
Empire, prior to the name change as registered with the Colorado Secretazy of State's Office) request to
extend the permit decision date for Permit Renewal No. 4 until April 1, 2006. This request was received
via an electronic mail transmission on Mazch 1, 2006. The Division will grant the requested extension
of the proposed decision date for Permit Renewal No. 4 until April 1, 2006. BTU-Empire provided
documentation of the resolution of aright-of--entry dispute on the Eagle Mine permit area on January 24,
2006. BTU-Empire currently is in the process of atransfer-of-operator, SO-2, permitting action with the
Division. As has been discussed between the Division and yourself, it is logical to complete the
transfer-of-operator, SO-2, permitting action prior to the Division making a proposed decision on RN-
04. Permit renewal No. 4 proposed decision date shall be extended until April 1, 2006.
