NOTICE OF PROPOSED DECISION The Colorado Mined Land Reclamation Division has issued a proposed decision to approve a technical revision to the mining and reclamation plans for the Seneca II Mine, Permit No. C-80-005, operated by Peabody Coal Company, Western Division, under the provisions of the Colorado Surface Coal Mining Reclamation Act of 1979. The proposed technical revision (TR - 022) was submitted by Peabody Coal Company, Western Division, on August 26, 1991. The affected area is located in: T5N R87W Section 1: All Section 2: All Section 3: Portions of El/2 E1/2 Section 11: NE1/4, N1/2 NWl/4, SE1/4 NW1/4, NEl/4 SE1/4, NE Diagonal 1/2 NW1/4 SE1/4, and NE Diagonal 1/2 SE1/4 SE1/4 Section 12: All Section 13: N1/2 N1/2 N1/2 T6N R86W Section 27: Portions of the following - SE1/4 SW1/4, SWl/4 SW1/4, SW1/4 SE1/4 and SE1/4 SE1/4 Section 34: El/2 El/2, NWl/4 NE1/4, portions of NE1/4 NW1/4, portions of SW1/4 NEl/4 Section 35: Wl/2, W1/2 E1/2, portions of SEl/4 NE1/4, portions of E1/2 SE1/4 Section 36: Portions of S1/2 S1/2 TSN, R86W Section 6: Wl/2 Wl/2 SW1/4 Section 7: Wl/2 NW1/4 NW1/4, N1/2 SW1/4 NW1/4 All west o f the 6th Principal Meridian, totalling 3,444 acres in Routt County The subject technical revision proposes to change the design of Sediment Pond 008 and Diverion No. 1. Copies of the proposed technical revision are available for review at the Colorado Mined Land Reclamation Division office, 1313 Sherman Street, Room 215, Denver, Coiorado 80203. Any person who has an interest which is or may be adversely affected may request a formal hearing regarding this proposed decision. Requests for a formal hearing must be made in writing within ten (10) days of this publication and shall state with reasonable specificity the reasons for the request and objections to the proposed decision.
