Long <br />1300 South Yale Street Division Director <br />Flagstaff, Arizona 86001 <br />RE: Seneca 11 Mine (C-80-005 SO-O1) <br />Seneca II-W Mine (C-82-057 SO-O1) <br />Transfer of Permits <br />Dear Mr. Wendt: <br />We have received your requests to transfer the above mentioned mine permits to Seneca Coal <br />Company. A preliminary review of the items submitted indicates there are minor deficiencies in <br />the appltcatlon packages. Prior to approval of the transfers, the following items must be revised <br />or subbmttted. <br />1. The insurance certificates for both operations need to be revised since: <br />a. The address for Seneca Coal Company is not the same address as is given in the <br />revised permit application package. Please have the issuer correct the address. <br />b. The certificates have a clause regarding cancellation which is unacceptable as written. <br />Please have the issuer of the certificates delete from the clause the phrases "endeavor <br />to" and "failure to mail such notice shall impose no obligation or liability of any kind <br />upon the company, its agents, or representatives." <br />2. Pages in the revised text (3-14 in C-80-005 and Tab 3 page 1 of C-82-057) refer to revised <br />Attachments 3-1 and 3-2 which show proof that Seneca Coal Company is licensed to do <br />business in the State of Colorado and has rights to certain properties and leases. The copies <br />of our submittals do not contain these documents Please provide six copies of the <br />described documents for our review. <br />3. As you noted in your application cover letter, we are still in need of revised performance <br />bonds. <br />We have forwarded new ownership and control information for Seneca Coal Company and its <br />parent corporations to the Office of Surface Mining for Applicant Violator System updates. Once <br />the updates have been made, the Division can make the required system queries for compliance <br />history and approval of the permit transfers. We will keep you apprised of the status of that <br />review. <br />
