§2.05.6 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING ACTIVITIES- <br />MINIMUM REQUIREMENTS FOR OPERATION AND RECLAMATION PLANS. <br />2.05.6 Mitigation of Surface Coal Mining Operation Impacts. <br />(6) (b) (i) (C) (Cont'd.) <br />technologically feasible means are available to restore these <br />structures to pre-subsidence status. Refer to Subsidence Repair <br />Handbook, Volume 3. <br />(6) (b) (ii) <br />In accordance with Section 2.05.6(6)(b)(i), a determination was made <br />that material damage or diminution of foreseeable use might occur as <br />a result of mine subsidence. In order to substantiate the degree of <br />effect, a monitoring program has been established in accordance with <br />Section 2.05.6(6)(c). Refer to Section 2.05.6(6)(c)(i)(B) fox <br />specific information. Subsidence monitoring will continue until the <br />operator, in concurrence with the Division, decides subsidence <br />monitoring is no longer required. <br />TR-39 gained the Division's approval for the cessation of subsidence <br />monitoring and reporting requirements for the entire permit area. <br />This agreement was based on: <br />• The cessation of underground mining activities. <br />• A minimum of 9 years of continued surveillance on all <br />monitoring points since the cessation of mining activities. <br />• The following of approved practices during the mining <br />activities which provided additional assurance that material <br />damage and diminution of foreseeable uses would not occur. <br />• A conclusion that the following of these practices have <br />successfully prevented material damage and diminution of <br />foreseeable uses. <br />A new subsidence monitoring plan will be submitted and approved prior <br />to any new mining activities that could cause material damage or <br />diminution of foreseeable use which might occur as a result of mine <br />subsidence. <br />(6) (b) (iii) (A) <br />However remote, the potential exists for material damage to the <br />surficial aquifers comprising Renewable Resource Lands and <br />structures. The Operator commissioned Geo-Hydro Consulting, Inc. to <br />conduct a subsidence survey as defined in Section 2.05.6(6)(eJ. Ths <br />study evaluates potential effects to all land uses within the permit <br />area. <br />(6) (b) (iii) (B) <br />Additionally, in order to transform lease stipulation "g" into an <br />operationally feasible and technically justifiable mine plan, the <br />Operator has prepared a Subsidence Control Plan as defined in Section <br />2.05.6(6)(£). <br />(6) (c) (i) (A) <br />Material damage and diminution of foreseeable use ase remotely <br />possible at the Bowie No. 1 Mine, and as such, subsidence is not <br />required.
