Kugel <br />Division Enginett <br />Re: Review of Bowie No. 2 Mine, Permit Revision No. 10, Revised B-Seam Mine Plan, CDMG Permit <br />No. C-1996-083 <br />Dear Mr. Dudash: <br />The purpose of this letter is to provide our review comments of the subject permit application submitted <br />by Bowie Resources, LLC (hereafter Bowie). Our office is in receipt of the revised B-Seam Mine Plan <br />application dated February 28, 2006 submitted on behalf of Bowie by J.E. Stover & Associates, Inc. As you are <br />aware, the primary concern of the Division of Water Resources (DWR) is the potential impact ofmine-induced <br />seismic activity and/or surface subsidence on the safety of Bruce Park Dam and related impact to the massive <br />landslide located upstream of the right abutment. <br />Several of the permit revision documents with respect to Bruce Park Dam and the landslide were <br />generated in response to permit Stipulation Number 9 and subsequent correspondence between the Colorado <br />Division of Minerals and Geology (DMG) an the previous dam safety engineer in our office, Mr. Jim Norfleet. <br />Of particular importance, Stipulation Number 9 states in part that Bowie is responsible for providing a detailed <br />subsidence study to establish baseline conditions, potential mining-induced seismicity and potential translated <br />effects to the dam. Our current review of the submitted documents takes into account Stipulation Number 9 and <br />subsequent correspondence between DMG and DWR. <br />The current permit application references Volume X, Geotechnical Studies, Bmce Park Dam, which was <br />submitted as supporting documentation for the withdrawn Technical Revision No. 22. The study, performed by <br />GEI Consultants, Inc., provides a detailed evaluation of the effects that mining could have on the static and <br />seismic stability of the dam and landslide. Our letter to DMG dated June 11, 2003 provided a review of the <br />geotechnical report and supported the conclusion that, for the seismic loads analyzed, the dam embankments <br />would not appear to experience significant deformation. Otu current review supports the previous conclusion that <br />risk of the dams failing due to the seismic loading appears minimal based on the analyses provided. <br />The GEI geotechnical report also provides a stability analysis of the landslide located upstream of the right <br />abutment of the main Bruce Park Dam.
