The approval was issued in response to an <br />' application made by, among others, Western Mobile, Boulder, Inc. ("Western Mobile"). It <br />requested the authority to mine sand and gravel on approximately 647 acres within an 881-acre <br />area located east of North Foothills Highway, and south of Ute Road, in Sections 20, 21, 22, 27, <br />' 28 and 29 of Township 3 North, Range 70 West. During the Summer of 1999, Western Mobile <br />filed an application with the Division of Mmerals and Geology (DMG) at the Colorado <br />Department of Natural Resources to amend its Mined Land Reclamation Permit No. M-74-015 to <br />' conform with SU 96-18. <br />The amendment application requests authorization to, among other things, mine sand and <br />' gravel located within 200 feet of utilities or structures owned by Boulder County. Western <br />Mobile is therefore required by the DMG to obtain the notarized agreement of the utility or <br />structure owner, in this case, Boulder Cour-ty, that it understands that Western Mobile shall <br />compensate Boulder County for any damage to any Boulder County utility or strudLae that may <br />occur as a result of Western Mobile's mining and reclamation activities associated with Mined <br />Land Reclamation Permit Amendment No. M-74-015. <br />If this is agreeable, please execute and notarize this letter and return it to me.
