LAFARGE <br />soar c. t~,aahi <br />' vwel. saws ova <br />~~~~ <br />February 21, 2000 <br />' Mr. John Lohr <br />Southdown, Inc. <br />5124 Ute Highway <br />Post Office Box 528 <br />Lyons, Colorado 80540 <br />Dear John: <br />Re: Lyons Pit - Rockn' WP <br />Mined Land Reclamation Permit Amendment No. M-74-015 <br />Western Mobile, Inc., a Subsidiary of Lafarge Corporation <br />In June 1999, Western Mobile filed an application with the Division of Minerals and <br />Geology ("DMG") at the Colorado Department of Natural Resources to amend its Mined Land <br />Reclamation Permit No. M-74-015. The amendment application requests authorization to mine and <br />' process sand and gravel located on property described in a document entitled "Memorandum of Sand <br />and Gravel Mining Lease" ("Lease") dated March 17, 1994, between Southdown, Inc. and Mineral <br />Reserves, Inc., a wholly-0wned subsidiary of Lafarge Corporation. <br />As a condition of the amendment approval, Western Mobile is required to obtain the legal <br />right to enter the leased property, as is reflected in the Lease. We are also required to obtain the <br />notarized agreement of the landowner, in this case Southdown, that should any man-made structure <br />belonging to Southdown and located within 200 feet of the permit area be damaged by the mining, <br />Western Mobile shall compensate Southdown for the damage. This letter also clarifies that Western <br />Mobile is authorized to mine through certain structures referenced in the Lease document itself that <br />may be within the pemtit boundary. However, should Western Mobile adversely impact structures <br />referenced in the Lease that are to be maintained post-mining, Western Mobile will, agaiq be <br />' responsible for replacing such structures or otherwise compensating Southdown for the resulting <br />impact(s). <br />ff this is agreeable, please execute and notarize this letter and return it to me.
