© Mr. Jim R BaixeU <br />Colorado Divirian of Minerak ¢Y Geokgy <br />Marsh 26, 2003 <br />Page 2 <br />Rather, OMLLC has recovered the limited available soil and suitable underlying materials during <br />foundation prepazation activities for each new progressive bench level of the West Valley FID, <br />placed these materials as a road berm at the upper limit of each fill bench, and then used these <br />materials to provide the required 4 feet of suitable cover over each completed fill bench (this <br />construction approach is outlined in the detailed design and construction plans presented in <br />Exhibit 2.05-E4, Mine Development Rock/Coal Refuse Facility Design). This approach has the <br />advantages of providing additional refuse &ll capacity within the azea of excavated suitable <br />material, limiting material movement distances, and providing cover materials that are essentially <br />the same as the surficial materials tha[ existed in the fill azea prior to disturbance. Given that the <br />limited soil materials recovered during the West Valley Fill and Haul Road construction project <br />have now been transferred to the North Elk Creek Soil Stockpile, these materials will be available <br />for furure reclamation of the azeas where they were originally recovered as well as to supplement <br />other available soil resources for overall site reclamation. It should be noted that OMLLC has <br />completed seeding of the first fill bench of the West Valley Fill with reasonable vegetative growth <br />on the suitable cover materials.. With this submittal, OMLLC has corrected the reference in the <br />Soil Recovery and Replacement Plan to accurately reflect actual operating practices. <br />Attached is a completed CDMG Permit Revision Application Form.
