Box 125 <br />Norwood, CO 81423 <br />Re: Inquiry concerning proposal to expand a 10 acre gravel pit (with 1 t 2 Permi[) [o an <br />80 acre pit (with 112 Pennit) "within existing property boundaries" pursuant to <br />Montrose County Zoning teguladons <br />Dear Ms. Gray: <br />In response to yotu inquiry, pkase be advised that it is my understanding that Section <br />Iv.6.b.(5) of the Montrose Cotmty Zoning Resolution allows the "mining of sand and <br />gravel or othtx minerals carting at the rims of adoption of Zoning Amendment No. 20.94 <br />[October 13. 1994) or subsequent expansion of existing operations within existing <br />property bouttdarics" as a use-bv-right. A use-by-right does not require a permit from the <br />Cotutty. 1 would he happy ro review documentation oo the above captioned proposal <br />relative to the property in question and provide an opinion as [o whether or not the <br />property qualifies under this provision of the Zoning Resolution. <br />Furtlterttrore, Section IV.6.c.(10) of the Montrose Bounty Zoning Resolution allows "new <br />mineral resource development and extraction operations aced facilities (including quarrying, <br />sand arsd gravel optxationg, asphalt and concrete batch plant facilities)" with a Special Use <br />Permit.
