Apex No. 2 Mine; Midterm Findings <br />rights prior to August 3, 1977. The Routt County Special Use permit on pages 13.01 and 13.02 of the <br />mining permit gave approval for mining along the county road right-of--way. <br />The Division granted approval, pursuant to Rule 4.05.18, for mining operations within 100 feet of Trout <br />Creek, a perennial stream. <br />V. Decision to Require Revisions: <br />Items that need to be brought up to date or defined more cleazly resulting from this mid-term review: <br />1. Please provide updated addresses for the permitting contact and inspection contact on page 3 of the <br />renewal application (dated 11/26/97), Rule 2.03.4(2). <br />2. In accordance with Rule 2.03.4(3), please assure that the information regazding Officers, Ownership, <br />and other "Persons" who "own or control" Sunland Mining Corporation or any of its parent <br />companies is up to date. <br />3. Are all items pertaining to Rule 2.03.4(3)(e), (4), and (6) currently cotrect? Please update any of the <br />information that is not current. <br />4. Please assure that all information pertaining to Rule 2.03.4(7) is current. <br />5. Please assure that all information regazding Rule 2.03.6 is current and provide updates as necessary. <br />6. Determining Vegetation Success, permit section 2.05.4(2)(e), is very confusing. Sunland Mining <br />corporation has kept historical pages in the permit with declazations of the applicable revegetation <br />standard, page 184.1 (rev. 11/20/95). Later in this same section are pages 184-10 and 184-1 I that <br />discuss the historical application of previous vegetation and include the "new" vegetation standazds <br />(rev. 6/10/98). While keeping the historical information in the permit is valid, the permit needs to <br />define what is historical and what the current standazds aze. Addition of a statement to this effect on <br />page 184-1 (rev. 11/20/95) or removal of this outdated information altogether would address this <br />concern. <br />7. A) Permit pages 183 (revised 11 /20/95) and 184 state that the mine yard was reclaimed in 1993. <br />The Annual Reclamation Reports from 1992 and 1993 indicate that reclamation was completed in <br />1992 and limited inter-seeding occurred in the yazd azea in 1993. Please review the reclamation <br />history information and bring this information into agreement. <br />B) Permit page 184.01 (revised 10/17/96) states that more drought tolerant species were needed in <br />the 2.5-acre "bench" azea. Later on the same page Sunland Mining Corporation indicates that the <br />2.5-acre area receiving limited inter-seeding in 1996 was in the "yazd" area. Please clarify this <br />conflicting information. <br />8. The revised reclamation success standards aze discussed on page 184-14. The diversity standazd is <br />discussed in terms of "relative importance". Please define "relative importance" and how Sunland <br />will measure this pazameter as it relates to the mine's reclamation standard. <br />
