CCCD incorporates by reference the comment$ of People's <br />Alternative Energy Services as if fully set forth here. <br />The attached comments are technical in nature and are submitted on!behalf of <br />CCCD by Scott Mefford, a geologist/groundwater specialist who has previously testified <br />before the Board on this matter; Bruce Marshall, hydrogeochemist; and Jerry Fifield, <br />surface water hydrologist and sedimentation erosion specialist, Exhibits I, P and 3, <br />respectively. <br />Please note the following additional legal objection to the report by BMRI and to <br />the Board's making a decision based upon the report which is currently bef)Jre it. In its <br />Order of January 25, 1999, at page 2, ¶ 3, the Board required BMRI to inst811 a new <br />monitoring well for the Santa Fe forniation in the vicinity of current wells IOW-2 or PW- <br />3. The data from this well (water level data, water quality data, and aquifer~testing data) <br />is not included in this report.
