Cattany <br />Commerce City CO 80022 Division Director <br />r Natural Resource Trustee <br />Re: 124th Estates Sand and Gravel Mine, Amendment Approval, Permit No. M-2001-085, Revision No. <br />AM-3 <br />Dear Mr. Schultejann: <br />On February 5, 2004 the Division of Minerals and Geology approved the Amendment application submitted to the <br />Division on November 7, 2003, addressing the following: <br />Incorporate affected acreage currently covered by M-2001-113, add 5 acres of the Henderson Ski Lake to <br />be used for dredging, add a new crossing over the Fulton Ditch, and add new access to 120th Avenue. <br />The terms of the Amendment No. 3 approved by the Division are hereby incorporated into Permit No. M-2001- <br />085. All other conditions and requirements of Permit No. M-2001-085 remain in full force and effect. <br />The estimated reclamation liability for this amendment is $9,230.00. The current reclamation liability for the <br />124th Estates Sand and Gravel Mine is $335,500.00. The current financial warranty being held by DMG for the <br />site is $435,500.00. The reason for the difference is that a $100,000.00 fmancial warranty reduction was approved <br />on January 7, 2004 (SR-Ol), however, a replacement bond was never submitted to our office. Therefore, this <br />revision is herby approved and the amount that can now be released is $90,770.00. If you provide a replacement <br />warranty, the new fmancial warranty should be $344,730.00.
