Notice of Proposed Decision <br />The Colorado Division of Minerals and Geology has issued a proposed decision to approve an application <br />for partial Phase 1 Bond Release [Bond Release Application No. 2 (SL,-2)] for the Roadside Portals, <br />Permit No. C-1981-041. The mime is operated by Snowcap Coal Company, Inc. under the provisions of <br />the Colorado Surface Coal Mining Reclamation Act of 1979. The mine is an underground coal operation <br />located approximately three miles northeast of Palisade, in Mesa County, Colorado, at the Interstate 70, <br />Cameo Exit No. 46. The pemut area is split east and west by the Colorado River and I-70. The bond <br />release application was submitted by Snowcap Coal Company, Inc., on December 30, 2002. <br />The proposed decision is based on successful completion of drainage control, backfilling and grading, <br />and/or facilities removal on approximately 133 acres, within specified portions of the pemut azea as <br />described in the bond release application. The current performance bond for the operation is <br />$3,264,149.00, in the form of a corporate surety, which applies to the entire permit azea. The Division is <br />proposing to release a total amount of $1,466,510.00, which represents approximately 44.9% of the <br />current bond amount held. The operator had requested release of up to $1,600,000.00, which included <br />costs associated with topsoil replacement at a number of locations. The Division's proposed decision <br />specifically excludes any liability release for topsoil replacement, which is properly evaluated as a <br />component of Phase II, but not Phase 1 bond release. <br />Copies of the proposed decision and associated fmdings are available for review at the Colorado Division <br />of Minerals and Geology offices, 1313 Sherman Street, Room 215, Denver, Colorado 80203, 101 South <br />Third, Suite 301, Grand Junction, Colorado 81501, and at the office of the Mesa County Clerk and <br />Recorder. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regazding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
