Long <br />Division Director <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Pazagraph 4, of the Colorado Revised Statutes, that on December 14, 2001, an application [o revise coal mining <br />operations at the Colowyo Coal Mine was considered complete for the purposes of filing. The revision was ~. <br />submitted by Colowyo Coal Company L.P.. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />This proposed technical revision to Permit C-81-019 waives (under the provisions of Rule 4.05.9(18)) the <br />requirement (Rule 4.05.9(17)) to perform quarterly inspections of certain impoundments (stock ponds) on <br />reclaimed areas of the mine. The requirement (Rule 4.05.9(14)) [o accomplish annual inspections of these ponds <br />remains in effect. <br />The Surface coal mining operation is on land located approxitnately 28 miles South of Craig. The permit azea is <br />further described as follows: <br />All or portions of Sections 2, 3, 4, 8, 9, 10, 11, 14, 15, 16, 17, 20, 21 and T3N, R93W; and Sections 13, 15, 22, 23, <br />24, 26, 27, 28, 33 and 34, T4N, R93W; 6th Prime Meridian. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle maps of Axial and Ninemile Gap. <br />The above-referenced technical revision application would not incorporate additional lands into the permit area or <br />alter mitigation measures. It does previously approved permit conditions. We are requesting your agency's <br />evaluation of the potential for impacts to cultural and historic resources. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have <br />your concurrence in order to approve this proposal. We aze required to make a fording that "the proposed <br />operations will not adversely affect any publicly owned park or place listed on or those places eligible for listing, <br />as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Board and <br />the Federal, State, or local agency with jurisdiction over the pazk or place." Therefore, we request that you submit <br />comments regazding your concurrence with, concerns with, or objections to this proposal. In order that we may <br />comply with regulatory time frames, we request that comments be submitted within fifteen (15) days of this letter. <br />
