RE: Bond Release Inspection of the Burlington Northern Railroad Loadout Lease Area,
Energy Fuels Mining Company, Raton Creek Mine, Permit No. C-82-055.
Dear Mr. Cordova:
Thank you for your prompt reply to my letter dated 11/10/93. As per your request, the Phase I,
II, and III bond release inspection for the Burlington Northern Railroad Loadout area has been
rescheduled for 1:00 p.m. on 11/29/93.
Individuals from the Division who will be conducting the inspection will include Dan Hernandez
and myself. Inspectors from the Albuquerque Office of Surface Mining may also be present.
You, of course, are welcome to accompany us if you so desire.
The public, per Rule 3.03.2(3) of the Regulations of the Colorado Mined Land Reclamation
Board for Coal Mining, has 30 days from either the last publication of the notice required by
Rule 3.03.2(1)(b), or the Division's inspection, whichever is later, to request an informal
conference. Informal conferences regarding bond release are described in Rule 3.03.2(4).
If no informal conference has been requested, then the Division, per Rule 3.03.2(5)(a), will
provide all required parties written notification of the proposed decision. As the landowner of
the property, your office is included under "all required parties." Per Rule 3.03.2(5)(a),
interested parties will have 30 days from either the inspection, or the fast publication of the
Division's proposed decisions, whichever is later, to request a public hearing per Rule 3.03.2(6).
Per Rule 3.03.2(5)(c), if no request for hearing is received within the 30 day period from the
inspection or the fast publication of the Division's proposed decision, the proposed decision of
the Division shall be final.
