9. Whether or not 16 inches of topsoil will be available <br />for reclamation. Section 34-33-114(2)(a), C.R.S. (1984); and <br />Rule 2.07.6(2)(b). <br />10. Whether the application should be denied because it <br />is inconsistent with the county special use permit which requires <br />NCEC to pave roads on site. <br />11. Whether or not NCEC should be permitted to leave an <br />unpaved road in place on site upon reclamation. Rules 2.05.5, <br />4.03.1(1)(f), and 4.16.1. <br />PROCEDURES <br />The parties shall make their presentations in the following <br />order. The time limits set out below are maximum limits and <br />shall be strictly enforced. Time not used during a presentation <br />may be reserved for use during rebuttal. The Board, in its dis- <br />cretion, may allow additional time when warranted. Upon the con- <br />clusion of each presentation the other parties shall be afforded <br />an opportunity to cross-examine the witnesses that testified <br />during the presentation. <br />1. Introduction and Division recommendation. <br />The Division shall have 10 minutes in which to present an <br />introduction to the operation and to present its proposed deci- <br />sion to the Board. <br />2. GCA presentation. <br />GCA shall have 60 minutes in which to make its presentation <br />to the Board. <br />3. NCEC presentation. <br />NCEC shall have 30 minutes in which to make its presenta- <br />tion to the Board. <br />4. Division presentation. <br />The Division shall have 30 minutes in which to make its <br />presentation to the Board. <br />5. Rebuttal and closing statements. <br />-3- <br />
