. - <br />that demonstrates that such structures shall not be damaged by <br />proposed construction materials excavation operations;" <br />regardless of who owns the structure(s).\ <br />Provide DMG with a copy of an agreement with the owner, <br />including details of the operator's operating requirements <br />with regard to the structures. The Operator could also either <br />modify the Mining Plan such that no mining occurs within 200 <br />feet of the structures, or obtain an engineer's evaluation <br />stating that there will be no adverse affects on the <br />structures due to the mining. The engineer's evaluation must <br />include slope stability calculations and soil evaluations for <br />the site. <br />Finally, Mr. Donald E. Harley, one o; the adjacent landowners, sent <br />the Division a letter of comment on the application on May 29, <br />1996. In this letter, Mr. Harley expressed concern about the <br />effects of mining on the springs to the north and south of the <br />permit area, and requested that certain measures be taken to <br />prevent effects on these springs from the extended mining. We are <br />attempting to contact Mr. Harley at this time to ascertain whether <br />an Informal Conference will be necessary prior to July 15 to <br />address his concerns. If this becomes the case, then a date will be <br />set in the near future to meet with the Operators and Mr. Harley to <br />discuss these issues and to try to resolve them without a Board <br />Meeting being necessary.
