Box 1030 <br />Ranger District N Rio Grande Ave. <br />PHONE NO. 970-527-4131 Paonia, CO 51428 <br />FAX 970-527-4151 <br />File Code: 2$20-4 <br />Date: January 28, 2005 <br />Mr. Jim Burnell <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street <br />Room 215 <br />Denver, CO 80203 <br />Dear Jim, <br />The Grand Mesa-Uncompahgre-Gunnison Nation Forests (GMUG) has completed their review <br />of Mountain Coal Company's (MCC) Permit Revision 10 (PR-10) for the West Elk Mine. <br />Portions of the National Forest System (NFS) lands included in PR-10 aze part of Federal Coal <br />Lease C-1362, issued in 1967 and modified in 2001. The NFS lands were leased with a <br />stipulation for protection of non-coal (surface) resources within the lease. PR-10 proposes to <br />include portions of T. 13 S., R. 90 W., Sections 35, 36, and T, 14 S. R. 90 W., Sections 2, 10, 11, <br />that aze outside the coal lease boundaries (see Map 2 of PR-10), please note that right of entry <br />has not been given for these areas. <br />Pertaining to specific comments on PR-10, the GMUG offers the following: <br />Citation from permit package (page, table, etc.): <br />2.02=1 - 3`d pazagraph <br />Sunset Trail Exploration license is currently pending with the BLM per MCC's 2002 agreement <br />with the Wilderness Society, etal. This agreement stated that MCC will not pursue exploration <br />within the Sunset Trail azea until Forest Plan revision is complete or unti12007, whichever is <br />first. <br />2.04-2 - <br />Not every federal agency operates under FLMPA, which is specific to the BLM under the <br />Department of the Interior. It is the National Forest Management Act (NFMA) which requires <br />individual Forests to operate under a Land and Resource Management Plan. Please include the <br />language that states that the GMUG manages the NFS lands in the area according to the GMUG <br />Land and Resource Management Plan (1983), prepared in accordance with the NFMA. <br />2.04-3 - <br />Please add discussion of 9A management areas (Riparian area) as described in the GMUG <br />LRMP. Also acknowledge that the Forest Service has made the lands in the permit area <br />available for oil and gas leasing. <br />2.04-36 and 37 <br />This discussion should acknowledge that the Forest Service has stipulations on Federal Leases <br />that state surface use is prohibited on slopes greater than 60% and that special evaluation is <br />needed for surface use on slopes between 40% and 60%. <br />Caring for the Land and Serving People PrinleOOnReryGeGPaper <br />
