Long <br />Division Di~eclur <br />The Division has completed a preliminary adequacy review of the above mentioned application. <br />As a result of that review, we have the following questions and comments. <br />1. The cover letter states that copies of cover letters, to transmit the application to various <br />federal agencies, were attached. The Division did not receive those copies. Was the <br />revision forwarded to the BLM and OSM? Please inform the Division when the revision <br />will be or was sent to them. <br />2. Rule 4.05.9(1)(a) requires that the quality of water in permanent impoundments must be <br />suitable, on a year round basis for its intended use. P&M indicates the intended use is <br />for livestock and wildlife. Therefore, the water quality standards for livestock would <br />apply. I have enclosed a copy of those standards, taken from the Division's Proposed <br />Decision and Findings of Compliance document for Permit Revision No. 3 at the Edna <br />Mine. Please provide the Division with documentation that the quality of water <br />impounded in the Moffat pond will meet these criteria on a year round basis. <br />3. In accordance with Rule 4.05.9(d), before the Division can approve permanent retention <br />of the Moffat pond, P&M needs to provide proof that the necessary water rights have <br />been secured for retention of the permanent pool volume in the pond. Your cover letter <br />indicated this would be provided to the Division as soon as it becomes available. Receipt <br />of that documentation should satisfy this concern. <br />
