The highwall reduction task cost appeazs low. Please provide the basis for the calculations for the highwall <br />reduction task. This should also correlate to the slope gradient described in the mining plan, and supported by the <br />correct depth of the pit. <br />There are several cost entries concerning tasks performed on 35 acres, though it is not always clear which 35 acres <br />aze being included. Please clarify the azeas involved in the rough grading, the topsoil replacement, and the <br />revegetation. <br />Exhibit M -Other Permits and Licenses (Rule 6.4.131 <br />If this list is to include something from the Division of Water Resources (State Engineer's Office) please do so. <br />Exhibit N -Source of Le¢a1 Right to Enter (Rule 6.4.141 <br />The Warranty Deed includes information describing that only half the interest in the minerals is conveyed by this <br />deed. (This conflicts with the information on the application form itself stating that Henry and Rock Southway are <br />the only owners of the minerals.) Please clarify, and if there is another party, please provide the information. <br />Other Items <br />This office received no letters of objection for the application. The mailed notices and damage agreements all <br />appeaz correct. The four published notices began slightly late, but the public comment period has ended. <br />At this time the decision for this application has been set for May 12, 2004. Please provide all responses to the <br />adequacy questions in this letter by that date. If additional time is needed to prepaze and submit responses, a <br />written request for extension should be submitted.
