Cattany <br />Division Direttor <br />Natural Resource Trustee <br />I have reviewed the above-named amendment application, and overall find it well-prepared and straightforward. <br />There are a few small items that need to be clarified, however, though they should not be difficult. I have arranged <br />my comments in the paragraphs below in the order of the exhibit to which they pertain. Please arrange or label <br />your responses similarly to facilitate their review. Exhibits not noted herein are considered adequate at this time. <br />Exhibit A - Legal Description (Rule 6.4.1) <br />The description contains one small error in the metes and bounds of the boundary. The line reading "90° AZ 1301 <br />feet, thence" should be corrected to read "358° AZ 1301 feet, thence...." This incorrect azimuth is contained on all <br />maps in the amendment also (on the east end of the added parcel). The maps need not all be replaced, however, if <br />you can provide a statement clarifying how the mistake should be corrected. <br />Exhibit C -Pre-mining and Mining Plan Maps (Rule 6.4.3) <br />The mining plan map delineates the existing pits and the proposed pit. The proposed pit will avoid excavating <br />completely around the overhead powerpoles, but will leave them on peninsulas to ensure future access by the utility <br />owner. On the map delineations, a lazge area that is shown to be currently excavated is overlain by a portion of a <br />future peninsula (north of the residence, between the power poles), implying that a large backfill must occur. <br />Please clarify. <br />A similar situation is shown on the map where the south edge of the existing west pit is, again, implying that the <br />south edge will be backfilled. This area does not lie under an overhead powerline, and may be less critical, but it is <br />still uncleaz. Please clarify. <br />The map contains a representative cross-section of the pit slopes, showing them to be 3:1 in the zone of the water <br />line, and 2:1 at depth, in compliance with the pond slope requirement. Am I correct in assuming that pit slopes <br />during the mining phase will be maintained at these gradients? (This is asked since there is no slope information in <br />Exhibit D.) <br />Please describe or depict where the topsoil stockpiles will be located, especially within the amended area. <br />Exhibit D -Mining Plan (Rule 6.4.41 <br />The question about pit slope gradient during mining (in the previous pazagraph) is again asked under this exhibit, <br />and your reply may be included here if you wish. <br />Office of Office of Colorado <br />
