The Court, having revief~fiQLA,M1~'~~Qb~~V"the Motion Cot
Substitution of Receiver filed by University National Bank of
Fort Collins, N.A., having heard testimony in open Court, and
being fully advised in the premises, finds as follows:
1. On February 28, 1986, Plaintiff was appointed as
Receiver of the parcel of real property hereinafter [e[ecred to
as the "Property", more Eully described on M:xhibit A to which is
attached hereto and incorporated herein by roCocence.
2. Plaintiff has established thaC Chc parmiCCctc~, Class
Livestock Co., has failed to maintain compliance with the orders
of the Mined Land Reclamation Board (CMLRB), and its rnyu)al.iuns,
and has failed to maintain a valid Miriiny and k2eclarnaCion Permit
for Lhr Cravol Pit. Clara; ha:: rafut:ed lu Lt'an,fe[ Cho pnrmit [o
the Receiver to enable Receiver to remedy permit violations.
3. This failure to maintain compliance has resulted in the
Mined Land Reclamation Board issuiny au nrrlor un April 24, 1986,
which precludes mining and processing activities at the site.
Said Order required the posting of an additional financial
wa[ranCy in the amount of $7,500.00 to avt,id revocation of the
permit. 1n order to regain a valid CMI,RB perwiC. f.ur mininy uC
the Properly, additional information must be developed and
submitted to the CMLRB and additional approvals will be reyuired.
4. University National Bank was not notified l,y Class
hivestock of the non-compliance status of the permit i,rior [u the
CMLRB's April 29, 1986 order, and first received notica of the
Board's Order ort May 15, 1986.
5. Univer~~ity National Bank, in its capacity as Receiver,
has submitted the additional financial warranty reyuired by the
April 29, 1986 Order of the Mined Land Reclamation Board on May
28, 1986.
