T~-~ r~rsoy,
~~c
October 12, 2005
Ms. Erica Crosby
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Colorado 80203
RE: SW-TKO Joint Venture, LLC, Permit No. M-2004-078
Lupton Lakes Resource; Technical Revision 1
Response to Review
Dear Ms. Crosby:
CIVIL RES'~JURCES,LLC
EN6INEER9 6a PLANNERS

CCT i 3 2005 ~
In response to your email received earlier today, and pursuant to your discussion with Kevin Moore
of Lafarge, we offer the following:
1. Please make reference to the following stipulation below (it was required by the MLRB).
This includes construction of the silt ponds (since they expose groundwater).
"Stipulation No. 1: Prior to exposure of groundwater or any pit de-watering, or
installation of the underground recharge wells, the applicant will obtain approval from
the Division of Minerals and Geology of a water quality monitoring and mitigation plan
in the form of a revision to the permit. A copy of the revision shall be forwarded to the
objecting parry (Georgia Landrus) when submitted to the Division of Minerals and
Geology. The water quality monitoring plan must include a plan for collection of
baseline or ambient water quality samples, specify the water quality parameters to be
monitored, specify a point of compliance, specify the frequency of monitoring and
reporting to the Division, and specify a mitigation plan in the event of an exceedence of
a water quality parameter."
This Technical Revision No. 1 is intended to clarify the bonding requirements so the operator can
begin site preparation. The applicant and operator understand the permit condition; no
groundwater will be exposed until the water quality plan has been submitted to the Division.
2. Please state the amount of remaining bond that will be posted. Also, remove the
reference to Phase 3 and have a more general statement for any of the 'mining phases" (to
avoid confusion at a later date and if they decide to mine a different phase first)
The note #18 has been revised to read "Prior to any disturbance outside the settling ponds and
processing area, the applicant will post the additional bond required for the construction of the
compacted clay liner." The additional bond will be in the amount of $2,809,804. We initially
451 OAK STREET, SUITE ZOS ~ P.O. BOX 6B0 ~ FREOERIC K, CO 80530 ~ (3O3) 833-1 41 6 ~ (303) 833-2850 -FAX
