<br />Proposed Decision <br /> <br />The Colorado Division of Minerals and Geology has issued a proposed decision to deny a <br />Phase II/III bond release request for Block B, Mine 1, Permit No. C-81-071, operated by Colorado <br />Yampa Coal Company. This application requested fmal bond release for approximately 172 acres of <br />pastureland reclamation. The request was denied, in part, due to the lack of statistically adequate <br />data demonstrating that the lands included in the release area had been revegetated to the standards <br />required by the Rules regulating coal mining and the standards in the approved permit. Sediment <br />demonstrations, permanent drainage retention, permanent pond demonstrations, structure removal, <br />weed control, and water quality demonstrations were additional areas which had deficiencies <br />contributing to the denial. <br />A written findings is available for public inspection at the Colorado Division of Minerals and <br />Geology, 1313 Sherman Street, Room 215, Denver, Colorado 80203. Any person who might be <br />adversely affected or the head of any governmental agency which has jurisdiction with respect to <br />environmental, social, or economic impact involved in the operation may request an adjudicatory <br />hearing in front of the Mined Land Reclamation Boazd. The request for a hearing must be written <br />and state with specificity the reasons for the heazing. It must be received by the Division no later <br />than 30 days from the first publication of this notice. <br />
