Gnany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Pazagraph 4, of the Colorado Revised Statutes, that on April 7, 2005, an application to revise coal mining <br />operations at the Yoast Mine was considered complete for the purposes of filing. The revision was submitted by <br />Seneca Coal Company. All review and comment periods as provided in the Act and the Regulations initiate from <br />this date of filing. <br />This Permit Revision updates the life-of--mine plan For the Yoast operation, and contains modifications to the <br />mining, reclamation and associated plan and acreages for the remaining life-of-operation. Several factors and <br />other internal considerations have resulted in a corporate decision by Peabody Energy to cease coal production at <br />the Yoast mine in eazly 2006. This Permit Revision is a result of this decision, and addresses the revised mining <br />plan and the revised backfilling and grading schedule. The operator is proposing an overall reduction in disturbed <br />azea and affected area acres. <br />The Surface coal mining operation is on land located approximately 7 miles Southwest of Hayden, Colorado. The <br />permit azea is further described as follows: <br />T6N, R87W, Portions of Sections 28, 29 and 32 <br />TSN, R87W, All of Section 17; Portions of Sections 5, 8, 16, 18, 19, 20, 29, 30 <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Mount Harris and <br />Dunckley. <br />In accordance with the May 1991 Memorandum of Understanding (MOU) between our agencies, we must have <br />yow concurrence in order to approve this proposal. We are required to make a fmding that "the proposed <br />operations will not adversely affect any publicly owned park or place listed on or those places eligible for listing, <br />as determined by the SHPO, on the National Register of Historic Places, unless approved jointly by the Boazd and <br />the Federal, State, or local agency with jurisdiction over the pazk or place." Therefore, we request that you submit <br />comments regazding your concurrence with, concerns with, or objections to this proposal. th order that we may <br />comply with regulatory time frames, we request that comments be submitted within fifteen (15) days of this letter. <br />Please refer to the MOU when undertaking your review. <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geological Survey <br />
