Box 21588 <br /> Denver, CO 80221 -2425 <br /> Re: Deeoe Pit Amendment Application, Permit No. M-81 -302, Revision No. AM-01 <br /> Dear Mr. Hickman : <br /> On October 18, 1989, the Colorado Mined Land Reclamation Board found Mobile Premix <br /> Concrete, Inc. , a subsidiary of Western Mobile, Inc. , in violation of Mined Land <br /> Reclamation Division Permit No. M-77-139 for failure to comply with the mine plan <br /> and for mining without a permit. <br /> The Board, in Notice of Violation (NOV) M-89-020, ordered Mobile Premix Concrete, <br /> Inc. to: <br /> 1 . Submit a permit amendment to modify the mining and reclamation plan by <br /> November 21 , 1989; <br /> 2. Pay the Board a civil penalty in the amount of $25,000.00 by November 21 , 1989. <br /> As Section 34-32-120 of the Colorado Mined Land Reclamation Act (34-32-101 et seq. , <br /> C.R.S. 1973 as amended) states "No permit for new mining operations shall be — <br /> granted to any operator who is currently found to be in violation of the provisions <br /> of this article with respect to any operation in this state," you will need to <br /> comply with the Board ordered actions under Notice of Violation (NOV) M-89-020 by <br /> November 14, 1989 should you wish the Board to proceed with consideration of the <br /> Deepe Pit .amendment application on November 15, 1989. <br /> An alternative to complying with NOV M-89-020 by November 14, 1989 would be to <br /> adequately respond to the Division' s letter of August 14, 1989 by November 14, 1989 <br /> and, at the November 15-16, 1989 Board meeting, ask the Board to delegate authority <br /> to the Division to approve the Deeoe Pit amendment application only after Mobile <br /> Premix Concrete, Inc. has abated its violations. <br /> 215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
