The operation, maintenance, conduct, and monitoring of the recharge activities contemplated by this Agreement shall be under the sole control and supervision of the District, except for the Associations' right to determine and control the timing and amount of water that may be delivered to the recharge facility as provided in Paragraph 3. 10. The parties agree that the Association shall incur no liability for the delivery or use of the water delivered pursuant to this Agreement. The District agrees to indemnify and hold the Association harmless for any liability whatsoever that may be incurred by the Association as a result of the recharge activities contemplated by this Agreement. 11. Any party, by written notice, may change the address to which future notices shall be sent.
