Aggregate Source, Conditional Approval for PermitAmendment, Permit No. M-77-193 <br />Dear Mr. Tezak: <br />Action by the Colorado Mined Land Reclamation Board during a formal public hearing held on <br />November 16, 1995 resulted in the conditional approval of an amendment applicatioi submitted <br />by Tezak Heavy Equipment Company, lnc. (THECI) on April 4, 1995 to increase the permitted <br />acreage from 30 to 65 acres. The Board approval is contingent upon completion of all actions <br />specified in the four (4) conditions listed on pages 2 and 3. Failure on the pan of the operator, <br />THECI, to complete the specified actions within the timeframes listed in this Board Order will cause <br />the permit amendment to be void. <br />The Board conditionally approved the amendment application with the total reclamation cost for the <br />operation set at $164,400. Therefore, the Division requests that THECI submit within 60 days either <br />a replacement warranty for the entire 65 permitted acres in the amount of $164,400 or a <br />supplemental warranty (or the additional 35 permitted acres in the amount of $118,350.
