C-81-053) Midterm Review
Dear Mr. Martinez:
At Dan Mathews' request, I am enclosing a copy of the June 6, 1990 letter sent
to you in regard to the Division's midterm review and the list of the
remaining concerns that require responses by Blue Flame Coal Company. These
responses were due in the form of a Technical Revision application by July 31,
1990, Since you indicated to Mr. Mathews in your recent phone conversation
that you had misplaced your copy of the letter and since it is already past
the due date for the responses, the Division will extend the date for
submittal of the responses until August 15, 1990.
Please be aware that the Division believes that more than enough time has been
allowed for Blue Flame Coal Co. to respond to the Division's concern. Several
extensions of the response due dates have been made, but very little has been
accomplished to date. Continued failure by Blue Flame to adequately respond
within the required time frames would appear to leave the Division little
choice but to take enforcement action.
If you have any questions on the above, please contact Mr. Mathews or me.
Sincerely,

James C.
