Box 535 <br />Somerset, CO 81434 <br />RE: Emergency Mine Dewatering at the Sanborn Creek Mine (C-81-022) <br />Dear Ms. Welt: <br />This letter is to follow up on our phone conversations earlier today and to inform <br />you of the status of the Division's review of Minor Revision No. 51 which <br />addresses the emergency mine dewatering that Oxbow Mining Inc. is preparing <br />to undertake. We received a FAX copy of the minor revision application <br />yesterday and deemed the application complete today. Earlier today, we <br />received a FAX from Mayo and Associates of lab analyses of water samples <br />presumably taken from the well downdip from the dewatering bore hole and, a <br />FAX from the Colorado Water Quality Control Division of a letter written to <br />Oxbow explaining that Division's understanding of the situation at the mine. <br />As we have already discussed, this Division can approve the temporary <br />emergency mine water discharge once we have copies of the necessary <br />approvals from the WQCD. I should remind you that discharging mine water <br />from any point or system not included in the approved mine permit would place <br />Oxbow Mining Inc. in a situation of noncompliance. <br />We anticipate that our approval of this revision will be conditioned upon <br />satisfaction of two stipulations. Those stipulations would 1.) require submittal of <br />water quality analyses of discharged water and, a revision of the Probable <br />Hydrologic Consequences section of the Sanborn permit addressing probable <br />hydrologic impacts of the planned discharges and, 2.) submittal of as-built <br />designs for the mine water treatment pond. I will call you tomorrow to discuss <br />these two points. You should anticipate that we will require compliance with <br />
