PERMISSION TO DRILL <br />Western Fuels-Colorado, L.L.C., (hereinafter referred to as WFC) is hereby given permission to <br />drill one (1) test holes upon my (our) property, described as the following proximity, to wit: a <br />portion of Section 26, Township d7 North Range 16 West, NMPM, Montrose County, Colorado. <br />It is understood that I (we) will be paid One Hundred Dollars ($100.00) per hole drilled on my <br />property, the same payable in advance before WFC's entry upon the property. <br />WFC will stake each hole to be drilled in conjunction with the Surface Property Owner (Owner). <br />When the holes are staked, WFC will agree with the Owner as to drill rig access to minimize <br />surface disturbance. WFC will also cooperate with the Owner as to drilling schedule to give <br />Owner at least one week advance notice of drilling. <br />WFC agrees that it will plug each test hole immediately upon the completion of the drilling <br />activities at that hole, and upon the completion of the drilling program, herein agrees that it will <br />fill in all holes, ruts and depressions created by the drilling process. Plugging of the holes and <br />reclamation of the disturbed areas will be performed as per the rules of Colorado Division of <br />Minerals and Geology. WFC further agrees that upon the completion of the drilling program, it <br />witl remove all debris from the drill sites. <br />Additionally, within a reasonable period of time of completing the drilling activities updn the <br />properly, WFC shall deliver to Bennett one set of.drill logs pertinent to the hole completed on <br />the property. In the event that water is discovered in the hole, WFC shall then assist Bennett <br />with the governmental application process needed to transfer the drill hole from WFC to <br />Bennett.
