The information presented fn SCC's response letter dated October 31, 2005 isgenerally acceptable to meet the requirements for <br />permanent impoundments [Rule 4.05.9(13)]. However, this information should be provided in separate appendices to the permit <br />application package forfuture reference and for documentation in the pe»nit document as oppored to a letter, which will not be <br />incorporated into the approved permit document The dircussians presented in the response letter dated October 31, 2005 along <br />with the water quality demonstrations for Ponds 004 and 008 previously presented in the Mid-Term Review comment rerpanses <br />dated Apri129, 2005 are adequate, with the exception of the requirements for 4.05.9(13)(d) regarding water rights. There is na <br />pecif:c discusrion provided regarding the quantity of water available to water rightr holden. Separate appendices should be provided <br />for Ponds 004 and 008 addressing each requirement 4.05.9(13J(aJ through (~ with reference to the appropriate section(s) of the <br />permit docrrmend where applicable information is contained <br />On revised pages 13-47 and 13-52 (Revised 10/OS), SCC states that Appendix 7-6c (Sediment Pond 004 and Appendices 7- <br />6e and 76f (Sediment Pond 008) present permanent pond demonstrations for each pond, respectively. This doer not appear to be <br />the care; these appendices present design and ar-built documentation only. Please revise pages 1347 and 13-52 according to <br />delete the reference. <br />A.rprevivusly requested, p/eareprovide arAppendicer tv Hydrobgy Tab 7 of thepermit document rompktepermanent <br />impoundment demonstrations in accordance with Bute 4.05.9(13)(aJ through (lJ for Sedimentation Ponds 004 and 008. <br />On revised pages1347 through 13-52, SCC states that landowners have requested that Ponds 004 and 008 be retained as <br />permanent features. SCC also states that the executed requests have not been received by SCC. For approval ar permanent ponds <br />these landowner requests must be received and documented by the Division. Until rach time that the landowner request an received <br />by the Division, Ponds 004 and 008 will be considered nonpermanent featurr for the purpose of estimating the current <br />reclamation liability estimate. <br />Response: Appendices have been developed for Pond 004 and 008 Permanent Impoundment Demonstration and will <br />be included in tl~e Tab 7 appendices previously referenced. <br />SCC understands that the formal landowner requests axe still needed to finalize the Division's approval. <br />This package contains the revised or new information, and the insertion instmctions for updating the PAP.
