Cattany <br />Greg Lewicki and Associates, PLLC Division Director <br />11541 WamngtOn Court Natural Resource Trustee <br />Parker, CO 80138 <br />Re: North R-34 Pit File M-1996-008, Receipt of 112 Construction Materials Am endment Application Package <br />Dear Mr. Lewicki, <br />On February 22, 2007, the Division of Reclamation, Mining and Safety received your 112 Construction Materials <br />Amendment Application package for the North R-34 Pit, File No. M-1996-008. Preliminary review of the information <br />received determined that the following items must be received before the Division can consider your application as being <br />submitted and technical review can begin: <br />EXHIBIT A -Legal Descrintion (Rule 6.4.1): The legal description must identify the affected land and be <br />wholly adequate for field location of the property. It can be in the form of metes and bounds survey or a <br />description by reference to township, range and section to at least the nearest quarter quarter section. Where <br />applicable, the street address or lot numbers may be used. The range identified in the legal description does <br />not correspond to that in Division records for the site. <br />EXHIBIT P - Municipalities Within Two Miles (Rule 6.4.16): Please list any municipality(s) within two <br />miles of the proposed mining operation and address of the general office of each municipality. Please supply <br />the address for the general office for the municipality listed in the application. <br />EXHIBIT S -Permanent Man-Made Structures Bule 6.4.19): You must provide information sufficient to <br />demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected <br />land will not be adversely affected. Although the application included a Geotechnical Stability Exhibit, the <br />speciScs used to determine that the permanent man-made structures will not suffer damage related to this <br />operation were not included. Please supply agreements between the owners of these structures and the <br />operator or supply the geotechnical data used to determine that the structures will not suffer damage. <br />Your application will not be considered submitted until the information listed above is received and found sufficient to <br />begin our review. A decision date will be established 90 days from the date of receipt of all of the requested information. <br />Additionally, if you have already published notice you will need to republish notice, after the Division considers the <br />application submitted. This notice must be published once a week for four (4) consecutive weeks, starting within ten (10) <br />days of the date your application is considered submitted. We will notify you when you should initiate republication of <br />your notice. The final date for receiving comments is the 20th day after the fourth publication or the next regular <br />business day. <br />You have sixty (60) days from the above date to submit all necessary documents that the Office needs for an application <br />to be considered filed.
