That stated we would like request that some finality be <br />brought to this matter. <br />We do not believe that Peabody has not been negotiating_in eood faith this entire time. In fact they made <br />representations to our lawyer that efforts in meetings and discussions would be met with fruitful discussion <br />about a settlement that met certain criteria. Peabody pushed meeting to such a far date meeting any deadline <br />would be impossible. <br />8/10/2004 <br />
