Deg:.:,, ~,.,~,_~~; a~°.o.,rc°s Re: File No. 79-94, JD-7 Open Pit Mine, Montrose County Dear Mr. Campbell: In accordance with Section 112 (1.9) of the MLRB rules and regulations, Cotter Corporation submits herewith a request fora technical revision of the above captioned permit. The request for technical revision is founded on the opportunity to reduce the total affected land in Exhibit A from 650 acres to 490 acres. (See revised version of Exhibit A, attached hereto.) This opportunity arose in response to a change in the mine design and operating parameters. It should be noted that the reclamation schedule for the mine will proceed in a manner that is consistent with the permit, except the total acreage to be reclaimed will be reduced. Referring to Figure F-1 and revised Table D.4-la, the spoil pile will be reclaimed according to a progressive schedule. The integrity of the drainage design criteria dis- cussed during the permit application review will be maintained; however, the hillside acreage to be affected has been reduced. Cotter will not request a reduction in the bond amount for the JD-7 open pit at this time. However, upon completion of future reclama- tion activities, Cotter will petition the MLRB for a review of the bond status.
