<br />NOTICE OF FII.ING APPLICATION <br />COLORADO MINED LAND RECLAMATION PERMIT AMENDMENT <br />Notice to the County Board of County Commissioners <br />Grand County <br />The Climax Molybdenum Company, Henderson Mine and Mill (Henderson) intends to apply to <br />the Colorado Mined Land Reclamation Board (ML,RB) for an Amendment to its current Mining <br />and Reclamation Permit (M-77-342) for its mining and milling operation located in Cleaz Creek <br />County and Grand County. The attached information is being provided to notify you of the <br />location and nature of the proposed activities included in the Amendment. The entire <br />Amendment application will be on file with the Colorado Division of Minerals and Geology <br />(Division) and with the Grand County Clerk and Recorder at the time of its submittal to the <br />Division. <br />Henderson proposes to: 1) delete approximately 658 acres (Lost Creek reservoir site) from the <br />affected lands area; 2) change the post-mining land use at the mill site from "open forest" to <br />"rangeland"; 3) change the post-mining land use for a portion of the tailings impoundment to <br />water resource; and 4) change the post-mining land use at portions of the mine site from "open <br />forest" to "industriallcommercial" with the remaining portions of the mine site changed to <br />"rangeland", These changes are being proposed to update the Permit and to better respond to <br />fmanciai warranty conditions. The proposed changes will not increase mining or milling <br />capacities at the site. Pursuant to Section 34-32-116 (7)(j), CRS, the MLRB is required to <br />confer with the local Board of County Commissioners before approving the post-mining land use <br />proposed in the Amendment. Accordingly, the MLRB would appreciate your comments on the <br />proposed Amendment. Please note that, in order to preserve your right to a hearing before the <br />MLRB on this application, you must submit written comments on the application within twenty <br />(20) days of the date of the last publication on the notice pursuant to Section 34-32-112 (10), <br />CRS. <br />If you would like to discuss the proposed post-mining land use, or any other issue regarding this <br />permit Amendment application, please contact the Division, 1313 Sherman Street, Room 215, <br />Denver, Colorado 80203 (303/866-3567). <br />
