Cattany <br />ACling Division DIrKtO! <br />I reviewed the hydrologic data referenced in the submittal for an indication of the Apex <br />Mine's past compliance with applicable water quality standards and the Division's <br />Regulations covering hydrologic impacts. The results of my review aze summarized in <br />the attached checklist. I found that the Apex Mine has been in compliance with the <br />standards and the hydrologic impact regulations. The work proposed in the Technical <br />Revision (cessation of hydrologic monitoring) requires no additional bond from the <br />operator. More than 15 days has passed since other government agencies received our <br />letter notifying them of this Technical Revision. The results of my review support issuing <br />a proposed decision to approve this Technical Revision. <br />cc: Dan Hernandez <br />
