Please show your <br />Affected Land Boundary at the location of the maximum possible disturbances to avoid the possibility <br />of exceeding your permitted affected lands in the future. Your present Proposed New Mining Limit <br />(Affected Land Boundary) is at approximately a 400 fee[ setback from the existing property line. A 600 <br />feet setback could add as much as five plus, additional acres to the affected lands. This is significantly <br />more than the 13 acres proposed under the 400 feet setback. Please discuss <br />~ ~r why your reclamation cost figures are based on planting five acres at l00 trees per acre. If necessary, <br />~~ adjust figure F-2 to show the five acres where trees will be planted. <br />Exhibit N -Source of Legal Right to Enter <br />Please provide a copy of your U.S. Forest Service Special Use Permit for inclusion in your application. <br />That permit will document your legal right to access the amendment area to conduct mining operations. <br />If you will not have an approved Special Use Permit prior to the decision date, December 27, 2000, the <br />Division suggests that you either waive your right to a decision in 90 days or that you request a new <br />decision date that you are comfortable with, knowing that you will have secured legal right to enter. <br />Otherwise, the Division may deny your application on December 27, 2000, in accordance with CRS <br />34-32.5-I15 (4)(d). <br />
