Long <br />V Divmon Dkector <br />Request for Comments on Shapely Construction <br />Thank You for the opportunity to provide comment regarding the above noted Special Use Permit <br />application. We have reviewed the material and have the following comments: <br />• Any changes in the mining and/or reclamation plans currently specified in the reclamation <br />permit approved by the Division of Minerals and Geology (DMG1 that result from this Special <br />Use Permit application process may require a revision to the reclamation permit: for example, <br />the addition of berming to mitigate noise and sight concerns and revisions to the stormwater <br />control plan that involve construction of additional control structures. <br />• The berm proposed on the south side of the permit area appears to be a structure required <br />solely for the purpose of mitigating impacts of the gravel operation. In this case, the berm <br />must be constructed within the affected area boundary delineated in the approved reclamation <br />permit. The construction and reclamation of that berm will need to be incorporated into the <br />reclamation permit through our revision process and costs for reclamation of this berm must <br />be accounted for in the reclamation bond held by DMG. <br />• Any proposed stabilization measures to be implemented on the fill structure at the north end of <br />the DMG approved permit area, that will affect areas within that permit area, may need to be <br />incorporated into the reclamation permit. <br />If you need additional information, please contact me at the Division of Minerals and Geology, <br />Durango Field Office, 701 Camino del Rio, Room 125, Durango, Colorado 81301, telephone no. <br />970-247-5062. <br />Sincerely, <br />/~~ <br />./ - <br />Steve S.
