In regard to Corrective Action #1 noted in the Minerals Program Inspection Report for the Lariat Mine,
Robinson Brick Company (Robco) is asking fore 2°° extension to the original correction dated noted in the
report. The original correction date was 711 112 0 00 and in a letter dated July 7u' from Robco, a 30 day
extension was requested until August 10, 2000. "fhe 2nd eMensioa request is for 60 days.
During the period of the I st extension, please see the attached correspondence betwcen the State Engineer's
office and Robco in this regard. In addition, on Jttly 12", Robco made a site visit to Lariat with Mr. Greg
Ilammcr, Senior Professional Engineer with the Dam Safety Branch to discuss the current situation. Based
on the meeting with Mr. Hemmer. Robco obtained a`'Non-Jurisdictional Status" dam permit as the two
attached letters descrbe. However, in the letter dated Juty 20, 2000 from Mr. Richard Stenzel approving
the structure, the subject of water rights was raised.
As the letter from Mr. Stenzel requested I lust contacted Denise Miller on July 26~ but it wasn't until
August 9'" that she verbally concluded that no water rights issues were involved if the containment
shucture was classified as an Erosion Control Dam (F,CD) with two sere-feet of capacity or less.
An ECD requires a permit from the Office of the State Engineer and perhaps some additional modification
of [he existing structtue. This will take some time and consequently, Robco requires the 60-day extension
to eompletc this work
