Canany <br />Division Director <br />Natural Resource Trustee <br />The proposed use of the pond for evaporating water produced from coalbed methane wells can be approved <br />if there is continued compliance with the Division's Rules. Although the pond is no longer needed for <br />sediment control from the mining and reclamation operation (as explained on page 4-58 of the permit <br />application), it continues to be a regulated structure under the Coal Rules until it is either reclaimed or is <br />removed from the permit area as part of an approved change in postmining land use. We have reviewed <br />the proposed use for compliance with the Rules. <br />Please submit the following items for insertion in the permit application. Applicable sections of the Rules <br />are noted. <br />1. A description of the plan for operating the pond for storing produced water, including the expected <br />water quantities, water quality, and the number of months of operation [2.05.3(4){a)(ii)(C)]. <br />2. The timetable and plans to remove the pond [2.05.3(4)(a)(ii)(D)]. <br />3. An assessment of the hydrologic impact of the proposed use [2.05.3(4)(a)(i)(C)]. <br />4. A map showing the water pipeline corridor [2.05.3(3)(a) and 2.05.6(b)(vi)]. <br />5. An assessment of the potential for produced waters to adversely impact the revegetation plan in the <br />area of the pond [2.05.4(2)(c)]. <br />The decision deadline for MR-24 is March 23, 2007.
