MANAGEMENT <br />DEC 2 2 200q <br />pivision ~t Minerals and Geology <br />Re: Snowcap Coal Company <br />Reclamation Schedule Amendment - TR44 <br />DMG Permit C-81-041 <br />Dear Mr. Mathews: <br />The DMG's letter dated December 16, 2004, requested that Snowcap provide written <br />documentation to demonstrate that the prospective sale and contingent postmining land <br />use change revision submittal is likely to occur within a reasonable time period. <br />Attached is a copy the "Contract to Buy and Sell Real Estate" submitted by the <br />prospective buyers of the South Portal facilities area. Hopefully this addresses the <br />question posed regarding the serious intent of the buyers. <br />Keith Davis, AEP, suggested that this is a reasonable offer and has a high possibility of <br />being accepted when presented to the Board of Directors for Snowcap Coal Company. <br />If accepted by the Board, J. E.
