Long <br /> Division Director <br />Re: Deserado Mine (Permit No. C-81-018) <br />Proposed Decision -Technical Revision No. ~5 <br />Reduction In Refuse Area Cover Thickness <br />Dear Mr. Shrestha: <br />Enclosed you will find the Division of Minerals and Geology's Proposed Decision for Technical Revision No. 45 at the <br />Deserado Mine. Notice of the proposed decision will be published in the RangelJ• Times as soon as possible. The first <br />publication will initiate the ten (10) day public comment period for the Division's decision. <br />Documentation must be submitted to the Division demonstrating that a copy of the approved revision application was sent to <br />the Office of Surface Mining and the Bureau of Land Management. The material should be sent within IS days of final <br />approval. <br />The Division has concluded, based on review of the refuse area revegetation study final report, and consideration of baseline <br />soil and vegetation information, refuse cover depth studies conducted at other Colorado coal mines, and applicable literature <br />pertaining to soil depth requirements (or successful revegetation, that a minimum non-toxic cover thickness of 30 inches <br />(including a minimum topsoil thickness of 12"), will be sufficient [o allow For successful refuse area revegetation at Deserado. <br />We are therefore proposing to approve the referenced revision, and authorize the variance from the four fool cover thickness <br />requirement. We are also proposing to approve the reduction of the woody plant density standard from 3200 stems per acre <br />to 500 stems per acre. <br />Seedmix changes which had originally been included in this revision have been withdrawn, and are being addressed in the <br />context of the midterm review response technical revision (TR-48). <br />If you have any questions, please contact me. <br />Sincerely, <br />l <br />Dan T.
