The
purpose of this memo is to explain the 112 Reclamation Pernut application
process, your rights as either a party or a non-party, and the jurisdiction of the
Mined Land Board. The Office and Boazd operate under the provision of the
Construction Materials Act, (Act), if the application is for the extraction of
construction materials. We operate under the Hardrock Act (Act), if the
application is for the extraction of non-construction materials.
If an application fora 112 Reclamation permit for a Construction Materials or
Hazdrock operation is approved by the Board or Office, the approved permit is for
the life of the mining operation (Life of Mine) since our permits have no expiration
date. The permit may be revoked and the reclamation bond forfeited to the State
only by an action of the Mined Land Reclamation Boazd. Revocation and
forfeiture may occur due to an uncorrected violation of the Act, Rules and
Regulations, or the terms of the approved permit.
THE ROLE OF THE MINED LAND RECLAMATION BOARD BOARD):
The Mined Land Reclamation Boazd (NLRB or Boazd) is aseven-member Board
that serves at the pleasure of the Governor. The Governor appoints five Board
members from nominations submitted by each of the various constituencies
represented, such as the mining industry, conservation groups, and agriculture.
