Long <br />Division Dneaur <br />This letter is intended to clarify the Division's position on the issues <br />raised in item no. 4 of my letter to you dated April 11, 1996. The <br />Division's position is simply that we could not treat Urad tailing seep <br />water in the event of a bond forfeiture because Urad is a pre-Mined Land <br />Reclamation Act site for which the Division holds no bond, and, as such, <br />no money would be available to conduct the water treatment. Presumably, <br />some entity other than the Division would assume the responsibility for <br />protecting the stream from untreated discharge of Urad water. The <br />Division also recognizes the Henderson Mine's objection to putting water <br />conveyance facilities in place that may detract from the reliability of <br />Upper Urad tailing seep water containment. <br />An alternative that may serve the needs of both the Division and the <br />Henderson Mine, would be to put permit commitments and financial warranty <br />in place that would allow the Division to operate a separate water <br />treatment plant at the Henderson Mine, in the event of bond forfeiture, <br />for the treatment of Henderson Mine water during the period of site <br />reclamation. In order to facilitate this, the existing ponds could remain <br />in a state of relative readiness, or bond could be posted sufficient to <br />rebuild the ponds. This separate Henderson Mine treatment facility would <br />then become the Environmental Protection Facility that is required to <br />control the impacted water pumped from the mine, and the proposed Urad <br />Valley water treatment facility would not have to be incorporated into the <br />Henderson Mine permit. <br />It is the Division's understanding that a proposal will be forthcoming <br />from the Henderson Mine to address these issues. <br />Sincerely, -- ` <br />~~ <br />AUlef~2n~c.
